The Controller hereby, in accordance with Article 13(1) and (2) of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, repealing Directive 95/46/EC (General Data Protection Regulation, hereinafter the “Regulation”), as well as Act No. 18/2018 Coll. on Personal Data Protection and on amendments and supplements to certain acts, as amended, and Act No. 452/2021 Coll. on Electronic Communications, as amended, provides the data subject (the Buyer), from whom the Controller (the Seller) obtains personal data, with the following information and explanations.

These privacy principles and instructions form part of the General Terms and Conditions published on the Seller’s website.

2.2

The merchant informs consumers that there are no specific codes of conduct to which the Seller has committed. A code of conduct means an agreement or set of rules defining the Seller’s conduct, which the Seller has undertaken to comply with in relation to one or more specific business practices or sectors, where these are not established by law or other legal regulations or public authority measures.


III. Retention period

3.1

The Controller stores personal data of the data subject only for the period necessary to fulfil the contract and subsequent archiving in accordance with statutory retention periods imposed by applicable legal regulations.

If the data subject has consented to receiving marketing emails and similar offers, the personal data are processed for this purpose until the consent is withdrawn, but no longer than 10 years.

The Controller processes the following personal data on its website:

name, surname, address, email address, home telephone number, mobile phone number, billing address, delivery address, data obtained from cookies, IP address.

VI. Purposes of processing personal data and retention period

6.1 Main purposes include:

6.1.1 Registration, creation and processing of contracts and client data for the purpose of concluding contracts with third parties.
6.1.2 Processing accounting documents and documents related to business activities.
6.1.3 Compliance with legal obligations regarding document archiving (e.g. Act No. 431/2002 Coll. on Accounting).
6.1.4 Fulfilment of orders, requests, contracts and similar obligations of the data subject.
6.1.5 Newsletter, marketing and similar advertising activities of the Controller, based on consent.


VII. Legal basis for processing

7.1

If processing is based on consent, it begins only after consent is granted.

7.2

If processing is necessary for pre-contractual relations and the performance of a purchase contract (including delivery), the data subject is obliged to provide personal data. Without them, the contract cannot be fulfilled. In such cases, processing is carried out without consent.

Not applicable. The Controller does not transfer personal data to third countries.

The data subject has the following rights, in particular:

  • right of access to data (Article 15 GDPR)
  • right to rectification (Article 16 GDPR)
  • right to erasure (“right to be forgotten”, Article 17 GDPR)
  • right to restriction of processing (Article 18 GDPR)
  • right to data portability (Article 20 GDPR)
  • right to object (Article 21 GDPR)
  • right not to be subject to automated decision-making (Article 22 GDPR)
  • right to lodge a complaint with a supervisory authority

XI. Withdrawal of consent

The data subject may withdraw consent at any time, fully or partially, without affecting the lawfulness of processing prior to withdrawal. Withdrawal can be made by email or in writing to the Controller’s address.


XII. Right to lodge a complaint

The data subject has the right to lodge a complaint with a supervisory authority in the EU Member State of their habitual residence or workplace if they believe their rights have been violated.


XIII. Automated decision-making and profiling

The Controller does not carry out automated decision-making or profiling as defined in Article 22 GDPR.
